This Privacy Policy ("Policy") constitutes a binding legal agreement between you, the user ("User", "You", or "Your"), and Binary Tech LTD ("Company", "We", "Us", or "Our"), a limited liability company duly organized and existing under the laws of Libya, operating the Fulus (فلوس) platform and services.
This Policy governs the collection, processing, use, disclosure, retention, and protection of personal information and data in connection with your access to and use of the Fulus application programming interface (API), website, documentation, and all associated services, features, content, and applications (collectively referred to as the "Services").
By accessing, browsing, registering for, or otherwise using the Services in any manner, you expressly acknowledge that you have read, understood, and unconditionally agree to be legally bound by all terms, conditions, and provisions set forth in this Privacy Policy. Your continued use of the Services constitutes ongoing acceptance of this Policy and any subsequent modifications thereto.
If you do not agree to be bound by the terms of this Privacy Policy in their entirety, you must immediately discontinue all access to and use of the Services. Your failure to comply with this requirement constitutes unauthorized use of the Services.
This Policy shall be read and interpreted in conjunction with our Terms of Service. In the event of any inconsistency, ambiguity, or conflict between the provisions of this Policy and the Terms of Service, the Terms of Service shall take precedence and govern to the extent of such inconsistency.
1. COLLECTION OF PERSONAL INFORMATION
The Company collects and processes the following categories of personal information in connection with the provision of the Services:

The Company collects the User's name and electronic mail address.
1.2 Authentication Information
The Company collects authentication credentials to enable User access to the Services.
1.3 Financial Information
The Company collects payment amounts. Depending upon the payment method selected by the User, the Company may collect mobile telephone number and birth year, subject to a minimum age requirement of eighteen (18) years for certain payment methods.
1.4 Technical Configuration Data
The Company collects webhook endpoint URLs and authentication credentials configured by Users for integration purposes.
1.5 Communications
The Company collects and retains User correspondence with customer support services.
2. PROCESSING AND UTILIZATION OF PERSONAL INFORMATION
The Company processes User personal information for the following lawful business purposes and legitimate interests:
2.1 Service Provision
The Company processes User information to provide, maintain, and administer User accounts and deliver the Services.
2.2 Payment Processing
The Company processes User information to facilitate payment transactions and manage billing.
2.3 Webhook Delivery
The Company processes User information to deliver webhook notifications and manage webhook configurations.
2.4 Customer Support
The Company processes User information to provide customer support services and respond to User inquiries.
2.5 Marketing Communications
The Company processes User information to deliver marketing communications via electronic mail. Users are automatically enrolled in marketing communications upon account creation and may opt out at any time by following the unsubscribe instructions provided in each marketing communication.
2.6 Service Improvement
The Company processes User information in aggregated and anonymized form to improve Service functionality and quality.
2.7 Security
The Company processes User information to maintain the security and integrity of the Services.
3. DISCLOSURE OF PERSONAL INFORMATION TO THIRD PARTIES
The Company may disclose User personal information to the following categories of third-party service providers and entities under the circumstances described below:
3.1 Payment Processing Providers
The Company discloses financial transaction information to third-party payment processing providers for the purpose of facilitating payment transactions.
3.2 Email Service Providers
The Company discloses User contact information to third-party electronic mail service providers for the purpose of delivering service communications and support correspondence.
3.3 Authentication Providers
The Company utilizes third-party authentication providers exclusively for the purpose of User authentication and authorization. The Company does not disclose additional User information to these providers beyond what is necessary for authentication purposes.
3.4 Legal and Regulatory Disclosures
The Company may disclose User information to governmental authorities, regulatory bodies, or law enforcement agencies within Libya when required by applicable law, legal process, court order, or governmental request. Such disclosures shall be made only to the extent legally required and in accordance with applicable data protection regulations.
3.5 Prohibition on Sale of Personal Information
The Company does not sell, rent, trade, or otherwise monetize User personal information to third parties for any purpose whatsoever. All disclosures of User information are made strictly for the operational purposes described in this Policy.
4. SECURITY SAFEGUARDS
The Company implements and maintains technical, administrative, and physical security measures designed to protect User personal information from unauthorized access, disclosure, alteration, and destruction.
4.1 Security Measures
The Company employs industry-standard security controls to protect User information.
4.2 Limitation of Liability
The Company cannot and does not guarantee absolute security of User information. No method of electronic transmission or storage is completely secure. Users acknowledge and accept that any transmission of personal information to the Services is at their own risk. The Company shall not be liable for any unauthorized access to or acquisition of User information that occurs despite the implementation of reasonable security safeguards.
5. COOKIES AND LOCAL DATA STORAGE
The Company utilizes cookies and browser-based local storage mechanisms to facilitate the operation of the Services and enhance User experience.
5.1 Session Cookies
The Company uses session cookies to maintain authenticated User sessions.
5.2 Browser Local Storage
The Company stores User preference data, including theme preferences and language selection settings, in the User's browser.
5.3 Prohibition on Third-Party Tracking
The Company does not deploy, utilize, or permit third-party analytics services, advertising cookies, tracking pixels, or any other third-party data collection mechanisms on the Services.
6. DATA RETENTION PERIODS
The Company retains User personal information for the periods necessary to fulfill the purposes described in this Policy, comply with legal obligations, resolve disputes, and enforce agreements.
6.1 Account Information
Account information for active Users is retained for the duration of the User's active relationship with the Company. Upon account termination or deletion, the Company implements data anonymization procedures whereby personally identifiable information is rendered anonymous. Aggregated, anonymized statistical data may be retained for analytical purposes.
6.2 Transaction Records
Financial transaction records are retained as required for legal compliance, accounting obligations, and tax reporting requirements under applicable Libyan law.
6.3 Support Communications
Records of User correspondence with Company support services are retained to maintain service quality and ensure continuity of customer support.
7. USER RIGHTS AND DATA SUBJECT REQUESTS
Users are entitled to exercise the following rights with respect to their personal information collected, processed, and retained by the Company:
7.1 Right of Access
Users have the right to request and receive confirmation of whether the Company processes their personal information, and to obtain access to such personal information in a structured, commonly used format.
7.2 Right to Rectification
Users have the right to request correction, modification, or update of inaccurate, incomplete, or outdated personal information maintained by the Company.
7.3 Right to Deletion and Anonymization
Users have the right to request deletion of their account and associated personal information. Upon such request, the Company will implement data anonymization procedures to render personally identifiable information anonymous, while retaining aggregated statistical data as described in Section 6.1.
7.4 Right to Data Portability
Users have the right to request and receive a copy of their account usage history and transaction records in a portable, machine-readable format.
7.5 Right to Withdraw Marketing Consent
Users have the right to withdraw consent to receive marketing communications at any time by utilizing the unsubscribe mechanism provided in marketing emails or by submitting a request to the Company.
7.6 Exercise of Rights
To exercise any of the rights described in this Section 7, Users may submit a request to the Company via electronic mail at support@fulus.ly. The Company will process such requests in accordance with applicable data protection regulations and respond within a reasonable timeframe.
8. AGE ELIGIBILITY
The Services are available to Users of all ages without restriction. The Company does not impose minimum age requirements for account registration or use of the Services. However, Users who are minors under the laws of Libya are advised to obtain parental or guardian consent prior to accessing or using the Services, providing personal information, or engaging in financial transactions through the platform.
9. AMENDMENTS AND MODIFICATIONS
9.1 Right to Modify
The Company reserves the right to amend, modify, update, or replace this Privacy Policy at any time and for any reason, at its sole and absolute discretion, without prior notice to Users. Any such amendments or modifications shall become effective immediately upon publication of the revised Policy on the Services.
9.2 Notification of Material Changes
In the event of material changes to this Policy that substantially affect User rights or the Company's data processing practices, the Company will provide notice to Users via electronic mail to the email address associated with their account. Notwithstanding such notification, Users are responsible for periodically reviewing the current version of this Policy.
9.3 Version Control
The Company maintains version control of this Policy, with each version identified by version number and effective date displayed at the end of this document.
9.4 Acceptance Through Continued Use
Continued access to or use of the Services following the publication of any amendments or modifications to this Policy constitutes User's acceptance of and agreement to be bound by such changes. Users who do not agree to any amendments or modifications must immediately discontinue all use of the Services.
